Problem

The F/M ratio in India is 940:1000 and still decreasing due to large scale selective abortions of female feotus and deaths of female infants.

As time passes, the techonology to determine sex before birth becomes cheaper and cheaper, and more and more available. The technology, sonography etc, are useful and indispensible in treating patients suffering in several areas and so these techonologies cannot be outrightly banned. And if allowed, it becomes possible for using the technology for pre-birth sex determination as well.

The solution I am proposing is to make the female child more attractive to the parents, so that they are less likely to resort to selective abortion of female feotus.



Solution

In a nut shell, the solution is as follows :

(Twins : Twins sons will be counted as one male child ; twin daughters will be counted as 1-2 daughters, as may be favorable to the parent ; if twins are one son, one daughter it will be counted as one duaghter)

Any case, other than above, the payments will be NIL.

The payments are monthly Now questions are :

The code of some 16 EASes (Equal Allowance Systems) answers both of the above questions. Consider EAS.01's Section-5B. Please click here to see the section. Section5B of my proposed procedure EAS.01 reads as :

    Section 5B : Procedures to reduce population growth

    5B.1 [Person responsible for this procedure/directive: Registrar; Purpose: Population control] Twelve months after passing this law, after re-approval of over 50% of the Corporators a)the Registrar will reduce 33% Allowances of men and women who have more than 2 children, the last children one must be born 2 years after this law is passed. b)the Registrar will reduce 66% Allowances of men and women who have more than 3 children, the last two children must be born 2 years after this law is passed

    5B.2 [Person responsible for this procedure/directive: Registrar ; Purpose: Reducing female infanticide] The Registrar will count 2 or less female children will count as 1 child in case of the above clause

    5B.3 [Person responsible for this procedure/directive: Registrar; Purpose: Reducing female feticide] Twelve months after passing this law, after re-approval of over 50% of the Corporators, the Registrar will give additional 33% Allowances to each parent with 1 or more female child and 66% additional Allowances to those with 2 or more female children.

In EAS.01, each citizen an allowance of underground water (in areas where water is NOT plenty, and water has significant economic value), which he may transfer to a bore-owner by outright sale, and thus earn cash. More the Allowances a citizen has, more cash he will be able to obatin. Now how does above section improve sex-ratio?

Clause 5B.1 merely demotivates person from having over 2 children, as he stands to loose. Will this motivate him to abort female feotus? NO. Clause 5B.2 and 5B.3 MOTIVATE him not only to retain the female kid, as having 1-2 female child does NOT reduce his Allowance, and may also increase his allowance and thus gain.

Each EASs I have proposed has Section-5B, which demotivates a person from having over 2 kids, and at the same time encourages him to have 1-2 female children.

IOW, a person gets more share in natural rsources if he female kids. IOW, it is SAME as offering CASH for bearing female children. This will be sufficient to improve famale/male ratio.



Is offering cash ethical

Is offering cash, or direct material benefit, which translates into cash, for bearing female child ethical? It is surely LESS unethical than forcing a father/mohthere to bear a female child, against their wish, and NOT offering cash at the same time.

Consider unethical aspect in existing law, which bans selective abortion, by imprisoning mother/father and also the doctor. The law DOES NOT ban abortion per se. In fact, GoI covertly encourages abortion as means to reduce popultion. Hence it is established, or assumed, that abortion is not murder, and not even a minor crime or even a vice. The ONLY thing that law bans is SELECTIVE abortion i.e. if a women aborts a foetus after sex-test, and foetus is female, then only man/wife are held guilty NOT otherwise. IOW, the law assumes that it is OK to force a female kid on the parents against their wish. If this is so, my proposal has NOTHING unethical as it only pays a couple to bear a female child. If forcing someone to do something is ethical, then surely paying someone to do the same is NOT unethical.

What is worse that law by itself is defuct. There is NO techonological way to stop a person from sex determination. Even if sex determination is established, it is based on witnesses's testimony and NOT a physical evidences. The witnesses' testimonies may be unrelaible, and may even change in court, making the law just another defunct good-for-nothing law. The ONLY way to implement the law is by giving wide discretionary power to police/courts to convict the accused. Such wide discretionary powers only increase corruption and also increase chances of innocents getting punished.

In addition, there is NO known way to establish guilts at individual level. Say a doctor uses sonography to determine sex of a foetus. Later, to avoid the charge, in court, the mother can always say she was forced by husband and in-laws to determine sex. The husband and her in-laws would say just the opposite --- i.e. mother had gone for sex-dtermination with her own choice, and there was NO pressure from kids. The court has NO means to establish guild/innocece.

My proposal, to pay parents to bear females, is ethical in one more way --- as of today, the society needs female kids more desperately than parents; so society better pay parents to get what it wants.

Allow me to eloberate. Reality is that a large number of parents DO NOT want female kids. Labeling this urge as bad or ugly is academic=useless (= time wasting) exercise to me. Now if sex ratio remains unbalanced, it can cause several disturbances in the society. So society needs female kids. IOW, society needs parents to do a favor, and so society better pay --- there are free lunches.

Hence there is nothing unethical in paying cash for bearing female kids.



Draft of the act to create procedure CIVIL.05

The code to provide cash to parents to bear female child is distributed in some codes of some 16 Equal Allowance Systems I have proposed. There is NO seperate code for CIVIL.05. Please click here to see the section in EAS.01 which improves female/male ratio.

Similar sections exist in EACH EAS. The EASes need to be passed in City Council, Assembly and Parliament. Now citizens can ask Councilors, MLAs and MPs to pass these Acts. But IMO, it will be wiser for citizens to first enact procedure LM.01, LM.02 and LM.03 then use them to pass these EAS acts WITHOUT any help from City Councilors, MLAs and MPs.
